AN ACT TO AMEND SECTION 25-11-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE APPOINTMENT OF THE DIRECTOR OF VETERANS AFFAIRS, SO AS TO ALLOW THE VETERANS OF FOREIGN WARS AND THE DISABLED AMERICAN VETERANS, ALONG WITH THE AMERICAN LEGION, TO MAKE A RECOMMENDATION TO THE GOVERNOR FOR A DIRECTOR AND TO PROVIDE THAT THE GOVERNOR IS NOT REQUIRED TO APPOINT THE PERSON RECOMMENDED.

Be it enacted by the General Assembly of the State of South Carolina:

Appointment of Director of Veterans Affairs

SECTION 1. Section 25-11-20 of the 1976 Code is amended to read:

"Section 25-11-20. For the purpose of carrying on this work the Governor shall appoint a Director of Veterans Affairs, who is charged with the duty of assisting all ex-servicemen, regardless of the wars in which their service may have been rendered, in filing, presenting, and prosecuting to final determination all claims which they have for money compensation, hospitalization, training, and insurance benefits under the terms of federal legislation. The Director of Veterans Affairs must be a person versed in federal legislation relating to these matters and the rules, regulations, and practice of the Veterans Administration as created by Congress and must be appointed by the Governor. Before the appointment, the Governor shall receive a recommendation from (1) the executive committee of the American Legion, Department of South Carolina, (2) the Veterans of Foreign Wars of the United States, Department of South Carolina, and (3) the Disabled American Veterans. The Governor is not required to appoint the person recommended and he is subject to removal by the Governor for cause."

Time effective

SECTION 2. This act takes effect upon approval by the Governor.
