TO APPROVE THE DISSOLUTION OF THE BEAUFORT COUNTY RECREATION DISTRICT IN BEAUFORT COUNTY, TO PROVIDE FOR THE TRANSFER AND CONVEYANCE OF THE FUNCTIONS AND ASSETS OF THE DISTRICT TO A DEPARTMENT OF BEAUFORT COUNTY GOVERNMENT, AND TO REPEAL ACT 1732 OF 1972, RELATING TO THE CREATION OF THE BEAUFORT COUNTY RECREATION DISTRICT.
Whereas, the Beaufort County Recreation District, in Beaufort County, created by Act 1732 of 1972, has been granted the authority to operate a recreation district within the boundaries of Beaufort County;
Whereas, a special election was held November 6, 1990, and a majority of the qualified electors of Beaufort County voted in favor of authorizing the Beaufort County Recreation District to transfer and convey the functions and assets of the Beaufort County Recreation District to a department of Beaufort County government; and
Whereas, the Beaufort County Recreation District is authorized by favorable referendum of a majority of the qualified electors of Beaufort County to dissolve the Beaufort County Recreation District and transfer its functions and related assets to a department of Beaufort County government. Now, therefore,
Be it enacted by the General Assembly of the State of South Carolina:
Property transferred
SECTION 1. The commissioners of the Beaufort County Recreation District, pursuant to an agreement and subsequent election, have transferred and conveyed the functions and assets of the Beaufort County Recreation District to a department of Beaufort County government. These actions have been approved by referendum.
District to cease operation
SECTION 2. At such time as the Beaufort County Recreation District transfers and conveys its remaining assets, as prescribed by this act, the Beaufort County Recreation District shall cease to exist, except for the purpose of winding up its affairs.
Offices abolished
SECTION 3. Upon the transfer and conveyance of the Beaufort County Recreation District's functions and its remaining assets, the commissioners of the Beaufort County Recreation District will have no further powers or duties, except to wind up the affairs of the Beaufort County Recreation District, and the offices held by the commissioners of the Beaufort County Recreation District are hereby abolished after all such matters have been completed. The commissioners of the Beaufort County Recreation Commission nmust not make any obligations, either written or oral, which financially or otherwise further obligate the district. There may be no further elections held to fill a vacancy on the Board of Commissioners of the Beaufort County Recreation District should a vacancy occur before the winding up of the affairs of the Beaufort County Recreation District and the final dissolution of the district itself.
Councils to be notified
SECTION 4. After winding up the affairs of the Beaufort County Recreation District, the commissioners must notify the Beaufort County Council that no further business remains to be transacted by the district, and that there is no further need for the district to continue in existence. The final dissolution of the Beaufort County Recreation District is effective when notice is received by the Beaufort County Council.
Act repealed
SECTION 5. Act 1732 of 1972 is hereby repealed.
Time effective
SECTION 6. This act takes effect upon approval by the Governor.
