TO AMEND SECTION 8-13-470, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PROHIBITIONS ON PUBLIC OFFICIALS AND PUBLIC EMPLOYEES AND OTHERS ON APPEARANCES BEFORE CERTAIN COMMISSIONS IN RATE-MAKING MATTERS, SO AS TO EXTEND THE PROHIBITION TO APPEARANCES BEFORE THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL AND TO INCLUDE REGULATORY AND PERMITTING MATTERS IN THE PROHIBITION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 8-13-470 of the 1976 Code is amended to read:
"Section 8-13-470. No public official or public employee shall may appear on permitting, regulatory, rate or price fixing matters before the South Carolina Public Service Commission, the South Carolina Dairy Commission the Department of Health and Environmental Control, or the South Carolina Insurance Commission in rate or price fixing matters. This prohibition shall also apply applies to partners or associates in the law firm of a member of the General Assembly. Whenever it is required by law for The provisions of this section do not apply when a member of the General Assembly is required by law to appear because of his business interest as an owner his ownership interest, or as an officer or employee of such the business, or in his official capacity as a member of the General Assembly, the provisions of this section shall not apply."
SECTION 2. This act takes effect upon approval by the Governor.
