S. 85

Introduced by SENATORS McConnell and Rose

S. Printed 6/10/91--S.

Read the first time January 8, 1991.

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 7-25-200 SO AS TO PROHIBIT THE SOLICITING OR CAMPAIGNING FOR VOTES WITHIN TWO HUNDRED FEET OF THE BUILDING IN WHICH A POLLING PLACE IS LOCATED AND PROVIDE FOR THE REMOVAL OF PERSONS VIOLATING THIS PROHIBITION.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 7-25-200. It is unlawful on an election day for a person or candidate to solicit votes or campaign for votes within two hundred feet of any entrance used by the voters to enter the polling place. The poll manager shall use every reasonable means to keep the area within two hundred feet of the polling place free from the prohibited activity, and the county and municipal law enforcement officers, upon request of a poll manager, shall remove a person violating this section. This section does not prohibit a candidate from briefly visiting the polls on election day to greet poll workers and voters."

SECTION 2. This act takes effect upon approval by the Governor.
