STATEMENT OF ESTIMATED FISCAL IMPACT

1. Estimated Cost to State-First Year $27,000

2. Estimated Cost to State-Annually

Thereafter $30,000

Senate Bill 868 amends current legislation so as to revise the eligibility requirement pertaining to a veteran's residency in South Carolina. This bill would provide free tuition for a child of certain veterans who were residents of the State at the time of entry into service and during service or who has been a resident of this State for at least one year.

According to the records of the S.C. Department of Veterans Affairs, most of the qualifying children will attend a technical school at an average cost of $1,000 per student. Last year 27 students were denied free tuition due to the length of residency in this State. The cost would be divided between various State Colleges and Technical Schools with a slight increase in tuition anticipated for the following year.

A BILL

TO AMEND SECTION 59-111-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO FREE TUITION FOR CERTAIN VETERANS' CHILDREN, SO AS TO REVISE AN ELIGIBILITY REQUIREMENT PERTAINING TO A VETERAN'S REQUIRED PERIOD OF RESIDENCY IN THIS STATE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 59-111-20 of the 1976 Code is amended to read:

"Section 59-111-20. A child of a veteran who was a resident of this State at the time of entry into service and during service or who has been a resident of this State for at least eighteen years one year as provided in Section 44-23-10(26) and, in the event the veteran is disabled, still resides in this State, who served honorably in a branch of the military service of the United States during a war period, as such these periods are defined by Section 101 of Title 38 of the United States Code:

(1) who was killed in action;

(2) who died from other causes while in the service;

(3) who died of disease or disability resulting from service;

(4) who was a prisoner of war as defined by Congress or Presidential proclamation during such war period;

(5) who is permanently and totally disabled, as determined by the Veterans Administration from any cause;

(6) who has been awarded the Congressional Medal of Honor;

(7) who is missing in action; or

(8) the child of any deceased veteran who qualified under items (4) and (5) may, upon application to and approval by the South Carolina Department of Veterans Affairs, be admitted to any state-supported college, university, or post high school technical education institution free of tuition so long as his work and conduct is satisfactory to the governing body of the institution."

SECTION 2. This act takes effect upon approval by the Governor.
