(R313, S892)

AN ACT TO AMEND ACT 554 OF 1971, RELATING TO THE CREATION OF THE PELHAM-BATESVILLE FIRE DISTRICT IN SPARTANBURG AND GREENVILLE COUNTIES, SO AS TO EXCLUDE ANY PROPERTY OF THE GREENVILLE- SPARTANBURG AIRPORT DISTRICT FROM THE FIRE DISTRICT AND REQUIRE TENANTS AND USERS OF THE AIRPORT TO PAY ONE HUNDRED PERCENT OF THE FIRE DISTRICT ASSESSMENTS FOR TAX YEARS 1991, 1992, AND 1993.

Be it enacted by the General Assembly of the State of South Carolina:

Findings

SECTION 1. The General Assembly finds that the Greenville-Spartanburg Airport District created by the General Assembly in 1959 provides fire protection services for itself, its tenants, and others who use its airport facilities so that, except in emergency mutual assistance situations, the airport district and its tenants do not require or expect fire protection services from the Pelham-Batesville Fire District.

Airport district property excluded from fire district

SECTION 2. Section 3 of Act 554 of 1971 is amended to read:

"Section 3. If a majority of those voting in the election vote in favor of the creation of the fire district, there is established the Pelham-Batesville Fire District in Spartanburg and Greenville counties encompassed within the lines as shown on a plat to be recorded in the R.M.C. offices of Spartanburg and Greenville counties. However, effective on and after December 31, 1993, any property of the Greenville-Spartanburg Airport District which would otherwise be included within the fire district as created by this act is specifically excluded from it. Tenants and users of Greenville-Spartanburg Airport shall pay one hundred percent of Pelham-Batesville Fire District tax assessments for tax years 1991, 1992, and 1993, in the manner provided by law."

Time effective

SECTION 3. This act takes effect upon approval by the Governor.

In the Senate House March 25, 1992.

Nick A. Theodore,

President of the Senate

Robert J. Sheheen,
