A BILL

TO AMEND ACT 245 OF 1983, AS AMENDED, RELATING TO THE BUDGETS OF SCHOOL DISTRICTS IN ORANGEBURG COUNTY, SO AS TO AUTHORIZE FOR FISCAL YEARS 1991-92 AND 1992-93 A SCHOOL DISTRICT TO RAISE ITS MILLAGE THREE MILLS IN EXCESS OF THE PRECEDING YEAR'S MILLAGE UNDER CERTAIN CONDITIONS, AND TO REQUIRE A PUBLIC HEARING BEFORE SUBMITTING THE BUDGET AND PROPOSED TAX LEVY TO COUNTY OFFICIALS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 1 of Act 245 of 1983, as last amended by Act 297 of 1989, is further amended to read:

"Section 1. The board of trustees of the school districts in Orangeburg County, before July first of each year, shall prepare a school district budget and shall determine the millage required for the operation of the schools in its district for the ensuing school year. For the fiscal years beginning July 1, 1991, and ending June 30, 1993, an Orangeburg County school district may raise its millage not to exceed the preceding year's millage by more than three mills, excluding any millage increases for inflation factors contained in the Education Improvement Act and the Education Finance Act. A millage increase in excess of the amount authorized by this section only may be set by the district board of trustees after a majority of the registered electors of the particular district voting in a referendum called by the district board of trustees and conducted by the county election commission vote in favor of the millage increase budget becoming effective.

Before September second of each year, each board of trustees shall notify the county auditor and treasurer in writing of the millage required for the operation of the schools in its district for the ensuing school year as determined by each board pursuant to this section. The notice by each board constitutes authority for the levying and collection of the millage upon all of the real and personal property within the school district. The levy must be placed to the credit of the district and expended within that district, except that only for fiscal year 1989-90 one additional mill must be levied and collected by the county treasurer to be used by the county board of education. An Orangeburg County school district may raise its millage only up to an additional five mills during the fiscal years beginning July 1, 1989, and ending June 30, 1991. After June 30, 1991, no Orangeburg County school district may raise its millage except as provided by referendum in this section. An Orangeburg County school district may raise its millage by five mills or more above the inflation factor prescribed in the South Carolina Education Improvement Act of 1984 only after a majority of the registered electors of the particular district voting in a referendum called by the district board of trustees and conducted by the county election commission vote in favor of the millage increase budget becoming effective.

Before submitting the budget and proposed tax levy to the county auditor and treasurer, each board of trustees shall hold a public hearing. Notice of the hearing must be advertised in a newspaper of general circulation in the district and must state the date, time, and place of the hearing."

SECTION 2. This act takes effect upon approval by the Governor.
