A BILL

TO AMEND SECTION 5-31-1520, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE EXTENSION OF A CITY'S OR TOWN'S WATER AND SEWER SYSTEM, SO AS TO REQUIRE REPRESENTATION ON THE GOVERNING BODY OF THE SYSTEM OF THE UNINCORPORATED AREA IT SERVES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 5-31-1520 of the 1976 Code is amended to read:

"Section 5-31-1520. Any A city or town may extend its system to any property beyond the city or town limits provided that if:

(1) Both the water and sewer systems are extended to such the property.

(2) The unincorporated area served by the system is represented on the governing body of the system based on the amount of service to the area. All members of the governing body must be selected in the same manner."

SECTION 2. This act takes effect January 1, 1995, except selection of members of the governing body of water and sewer systems pursuant to the amendment to Section 5-31-1520 of the 1976 Code in this act may occur before that date.
