AN ACT TO AMEND SECTION 4-9-39, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE FUNDING OF COUNTY PUBLIC LIBRARY SYSTEMS AND THE TRANSFER OF ASSETS AND PROPERTY OWNED BY ANY COUNTY LIBRARY PRIOR TO THE CREATION OF A LIBRARY SYSTEM UNDER SECTION 4-9-35, SO AS TO DELETE THE REQUIREMENT THAT ALL SUCH TRANSFERRED ASSETS AND PROPERTY BE USED EXCLUSIVELY FOR LIBRARY PURPOSES, AND PROVIDE THAT ANY DECISION TO SELL OR OTHERWISE TRANSFER THE PROPERTY FOR USE OTHER THAN FOR LIBRARY PURPOSES MUST BE MADE BY A TWO-THIRDS VOTE OF THE COUNTY GOVERNING BODY.

Be it enacted by the General Assembly of the State of South Carolina:

Transferred library property, assets; provisions deleted, added

SECTION 1. The second paragraph of Section 4-9-39 of the 1976 Code is amended to read:

"All assets and property, both real and personal, owned by any county library prior to the creation of a library system under Section 4-9-35 shall be transferred to the county by the persons or entities owning title thereto provided, however, any decision to sell or otherwise transfer the property for use other than for library purposes must be made by two-thirds majority of the county governing body."

Time effective

SECTION 2. This act takes effect upon approval by the Governor.
