AN ACT TO AMEND ACT 745 OF 1967, AS AMENDED, RELATING TO THE BOUNDARIES OF WESTERN CAROLINA REGIONAL SEWER AUTHORITY SO AS TO ADD A NEW AREA TO THE DISTRICT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Western Carolina Regional Sewer Authority (the authority) is a special purpose district created pursuant to Act 745 of 1967 and by prior Act 362 of 1925. The authority services areas of Greenville County, Laurens County, and Anderson County through the provision of wastewater trunk line and wastewater treatment services to various municipalities, certain sewer subdistricts, and other political subdivisions and is charged with planning responsibilities in portions of Spartanburg County under Section 201 of the Federal Clean Water Act. Sewer collection line service is provided by the foregoing local agencies within the authority's service area. The General Assembly finds that there exists the need to expand the boundaries of the authority's service area so that it may provide service to certain areas of Anderson, Greenville, and Spartanburg counties described in this act. Because the services provided by the authority are:
(1) matters of regional, rather than local, significance;
(2) are related to natural drainage basins;
(3) are concerned with regional environmental and health protecting efforts irrespective of and unconfined to county political boundaries; and
(4) because the authority's service area is located in more than one county, the General Assembly further finds that it is authorized to enact legislation relating to the authority including expanding the boundaries of the authority's service area. This legislation is consistent with the holding of the Supreme Court of South Carolina the case of Kleckley v. Pulliam, 265 S.C. 177, 217 S.E.2d 217 (1975), and is not violative of Article XIII, Section 7 of the South Carolina Constitution. The General Assembly further finds that there are no existing public service districts or special tax districts within these areas currently providing service in these areas and further that these changes have been requested by the County Councils of Anderson and Spartanburg and by the Commission of Public Works for the City of Greer.
Additional area added to authority
SECTION 2. Act 745 of 1967, as last amended by Act 270 of 1987, is further amended by adding additional territory to the authority as follows:
"Section 2.3. The authority also includes the following areas:
BEGINNING at a point 500 feet northwest of the centerline of State Highway 81 at the intersection of Wren School Road, (this being a point on the present boundary of the authority); thence running along a line parallel to and 500 feet northwest of the centerline of State Highway 81 to and across the intersection of State Highway 88; thence continuing in a southerly direction along a line parallel to and 500 feet west of State Highway 81 to the intersection of State Highway 8; thence continuing in a parallel line 500 feet southwest of State Highway 8 across the intersection of Interstate Highway 85 and on past the intersection with U.S. Highway 29 to the intersection of Looper Road (County); thence continuing parallel to and 500 feet west-southwest of the centerline of S.C. Highway 8 in a southeasterly direction to a point 500 feet from Palmetto Road; thence in a more southeasterly direction parallel to and 500 feet southwest of Palmetto Road to a point in the centerline of S.C. Highway 578; thence, in a due east direction to an unnamed creek north of Palmetto High School; thence, along the unnamed creek in an easterly direction to the Saluda River; thence in a northerly direction up the Saluda River to a point on the existing WCRSA boundary in Saluda River to the point of beginning.
BEGINNING at centerline of Buncombe Road (S-23-136) on bridge over Norfolk Southern Railroad then bearing north across U.S. 29 (Wade Hampton Blvd.) to intersection of N. Buncombe Road (County). Then bearing northwest on N. Buncombe Road to intersection of Fairview Road (S-23-109). Then bearing west on Fairview Road to N. Suber Road (S-23-540) then bearing south on N. Suber Road across U.S. 29 and continuing on S. Suber Road (S-23-540) to intersection of Norfolk Southern Railroad; thence following centerline of Norfolk Southern Railroad east to point of beginning.
BEGINNING at a point on the current boundary of Western Carolina Regional Sewer Authority at the point of intersection with Shelter Drive, thence N75-21E 486 feet to S.C. Highway 14. Thence along Highway 14 S29-28E 422 feet to point. Thence leaving said highway in a S29-40W 323 feet to a point in East Phillips Road. Thence along East Phillips Road N76-10W 200 feet. Thence continuing along East Phillips Road N76-07W 223 feet also in road. Thence N89-40W 132 feet to a point in the current boundary on East Phillips Road. Thence along the existing boundary in a northerly direction 442 feet to the point of beginning."
SECTION 3. (A) This act takes effect as to the city limits of the Towns of Pelzer and West Pelzer and the areas outside the city limits currently being served by these municipalities, upon approval by the Governor and conditioned further upon the execution and filing with the Clerk of Court of Anderson County of a contract by and between the authority and the Town of Pelzer and a contract by and between the authority and the Town of West Pelzer, among other matters, the provision by these municipalities of sewer collection service with the city limits and service area of the municipalities.
(B) This act takes effect as to the other areas in Anderson County and in Greenville and Spartanburg counties upon approval by the Governor.
