TO AMEND SECTION 50-11-390, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE OPEN SEASON, BAG LIMITS, AND METHODS OF HUNTING AND TAKING ANTLERLESS DEER, SO AS TO PROVIDE FOR THE REQUIREMENTS FOR ANTLERED DEER TO APPLY TO ANTLERLESS DEER IN GAME ZONE 11; AND TO AMEND SECTION 50-11-410, RELATING TO THE PROHIBITIONS PERTAINING TO ANTLERLESS DEER, SO AS TO PROVIDE FOR THE EXCEPTION IN GAME ZONE 11.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 50-11-390(A) of the 1976 Code is amended to read:
"(A) In Game Zones 1, 2, and 4 the department may declare open seasons and set bag limits and methods of hunting and taking antlerless deer provided in Sections 50-11-120 and Section 50-11-410. In Game Zone 11 the open season, bag limits, and methods of hunting and taking antlered deer apply to antlerless deer. In all other game zones the department may declare open seasons, set bag limits and methods of hunting and taking antlerless deer, and issue antlerless deer quota permits of fifty dollars each to landowners or lessees for the hunting and taking of antlerless deer. Derived revenue must be used to administer the permits and conduct deer research and management statewide."
SECTION 2. Section 50-11-410 of the 1976 Code is amended to read:
"Section 50-11-410. For purposes of this chapter, antlerless deer means a female, (doe), deer, a male, (buck), deer not exhibiting two inch antlers visible above the natural hairline, or a male, (buck), deer that has shed, broken, or otherwise lost its antlers. Except as provided in Section 50-11-390, in South Carolina, it is unlawful to hunt, kill, take, or possess any an antlerless deer on any property unless an open season has been declared on that property or an antlerless deer quota permit has been issued for the legal harvest of antlerless deer on that specific property. Any A person violating the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than two hundred dollars or imprisoned for not more than thirty days."
SECTION 3. This act takes effect upon approval by the Governor.
