A BILL

TO AMEND SECTION 56-28-10, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEFINITIONS UNDER THE PROVISIONS OF LAW REGARDING ENFORCEMENT OF MOTOR VEHICLE EXPRESS WARRANTIES, SO AS TO CHANGE THE DEFINITIONS OF "MOTOR VEHICLE" AND "NEW MOTOR VEHICLE" FOR THE PURPOSES OF CHAPTER 28, TITLE 56, TO INCLUDE MOTORCYCLES AND MOTOR-DRIVEN CYCLES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 56-28-10(4) and (5) of the 1976 Code are amended to read:

"(4) `Motor vehicle' means a passenger motor vehicle, as classified by Section 56-3-630, expressly including a motorcycle and a motor-driven cycle regardless of the provisions of Section 56-3-630, but excluding the living portion of recreational vehicles, trucks with a gross vehicle weight over six thousand pounds, and off road vehicles, which is sold and registered in this State.

(5) A `new motor vehicle' means a passenger motor vehicle, expressly including a motorcycle and a motor-driven cycle notwithstanding any other provision of law, which has been sold to a new motor vehicle dealer by a manufacturer and which has not been used for other than demonstration purposes and on which the original title has not been issued from the new motor vehicle dealer."

SECTION 2. This act takes effect upon approval by the Governor.
