A BILL

TO PROVIDE THAT MEMBERS OF ALL BOARDS AND COMMISSIONS MAY BE REMOVED IN THE SAME MANNER IN WHICH THEY WERE APPOINTED OR ELECTED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Notwithstanding any other provision of law, beginning July 1, 1993, all members of boards and commissions may be removed in the following manner:

1. those members appointed by the Governor may only be removed by the Governor.

2. those members appointed by the Governor with the advice and consent of the Senate may only be removed with concurrence of one-half of the Senate and the Governor.

3. those members confirmed by the General Assembly may only be removed by concurrence of one-half plus five of the General Assembly.

4. those members elected by the General Assembly may only be removed by concurrence of one-half plus five members of the General Assembly.

SECTION 2. This act takes effect upon approval by the Governor.
