AN ACT TO AMEND SECTION 17-13-90, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE SERVICE OF CRIMINAL PROCESS ON SUNDAY, SO AS TO PROVIDE THAT CRIMINAL PROCESS MAY BE SERVED ON SUNDAY FOR ALL CRIMES, FELONIES, AND MISDEMEANORS ALIKE.

Be it enacted by the General Assembly of the State of South Carolina:

Service of criminal process, Sunday; allowed

SECTION 1. Section 17-13-90 of the 1976 Code is amended to read:

"Section 17-13-90. Criminal process may be served on Sunday, as on any other day of the week, for all crimes, felonies, and misdemeanors alike. However, only law enforcement officers under bond shall be permitted to execute a search warrant."

Time effective

SECTION 2. This act takes effect upon approval by the Governor.
