TO AMEND SECTION 20-7-2205, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO TEMPORARY, INDETERMINATE COMMITMENT FOR EVALUATION FOR NONCRIMINAL MISCONDUCT, SO AS TO DELETE THE PROVISION THAT AUTHORIZED COMMITMENT FOR AN INDETERMINATE PERIOD NOT TO EXCEED FORTY-FIVE DAYS FOR THE PURPOSE OF EVALUATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 20-7-2205 of the 1976 Code is amended to read:
"Section 20-7-2205. A child who is guilty of a violation of law or other misconduct which would not be a criminal offense if committed by an adult or who violates the conditions of probation for such an offense shall not be committed to the custody of a correctional institution operated by the Department of Youth Services except for commitment for an indeterminate period not to exceed forty-five days for the purpose of evaluation, in accordance with the provisions of Section 20-7-2170 or to secure evaluation centers operated by the department."
SECTION 2. This act takes effect upon approval by the Governor.
