To whom was referred a Bill (H. 4518), to amend Act 36 of 1967, as amended, relating to the Spartanburg County Commission for Higher Education, so as to provide that the President of the University of South Carolina, etc., respectfully

A BILL

TO AMEND ACT 36 OF 1967, AS AMENDED, RELATING TO THE SPARTANBURG COUNTY COMMISSION FOR HIGHER EDUCATION, SO AS TO PROVIDE THAT THE PRESIDENT OF THE UNIVERSITY OF SOUTH CAROLINA, WITH THE ADVICE AND CONSENT OF THE BOARD OF TRUSTEES OF THE UNIVERSITY OF SOUTH CAROLINA AND THE SPARTANBURG COUNTY COMMISSION ON HIGHER EDUCATION, SHALL EMPLOY THE ADMINISTRATIVE OFFICERS AND FACULTY OF THE SPARTANBURG CAMPUS OF THE UNIVERSITY OF SOUTH CAROLINA.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Act 36 of 1967, as last amended by Act 617 of 1992, is further amended by adding Section 4A:

"Section 4A. The President of the University of South Carolina, with the advice and consent of the Board of Trustees of the University of South Carolina and the Spartanburg County Commission on Higher Education, shall employ the administrative officers and faculty of the Spartanburg Campus of the University of South Carolina.

The provisions of this section apply to any employment actions, including the renewal of existing contracts, taken after the effective date of this section; provided that the contract of a tenured member of the faculty or staff may only be nonrenewed as permitted by the applicable policies, procedures, and rules pertaining to the dismissal or termination of tenured personnel."

SECTION 2. This act takes effect upon approval by the Governor.
