TO AMEND SECTION 40-11-340, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTIONS FROM THE REGULATION OF CONTRACTORS BY THEIR LICENSING BOARD, SO AS TO EXEMPT CERTAIN WORK BUILT OR PERFORMED BY A COUNTY OR MUNICIPALITY WHICH HAS ADOPTED THE STANDARD BUILDING CODE AND WHICH HAS A CERTIFIED BUILDING INSPECTION DEPARTMENT, AND PROVIDE THAT THE EXEMPTION ONLY APPLIES TO WORK BEING DONE WHICH DOES NOT EXCEED THE CONTRACT LIMITATION OF A GROUP NUMBER TWO GENERAL CONTRACTOR UNDER THE REGULATIONS OF THE BOARD.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 40-11-340 of the 1976 Code, as last amended by Act 61 of 1989, is amended to read:
"Section 40-11-340. The provisions of this chapter do not apply to:
(a) contracts being performed on military reservation work, navy yard work, marine training station work, or to licensed fire sprinkler, burglar alarm, or well drilling contractors; or to
(b) a structure, road, building, bridge, sewer, grading, improvement, repair, or renovation being built or performed by a county or municipality which has adopted the Standard Building Code as published by the Southern Building Code Congress International, Inc., and which has a building inspection department which has been certified pursuant to it and which building inspection department applies the code as applicable to the county or municipality. This exemption only applies to work being done by these counties or municipalities which does not exceed the contract limitation of a group number 2 general contractor under the regulations of the board."
SECTION 2. This act takes effect upon approval by the Governor.
