A JOINT RESOLUTION

TO APPROVE REGULATIONS OF CLEMSON UNIVERSITY, STATE CROP PEST COMMISSION, RELATING TO BOLL WEEVIL QUARANTINE, DESIGNATED AS REGULATION DOCUMENT NUMBER 1719, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The regulations of Clemson University, State Crop Pest Commission, relating to Boll Weevil Quarantine, designated as Regulation Document Number 1719, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.

SECTION 2. This joint resolution takes effect upon approval by the Governor.

SUMMARY AS SUBMITTED BY PROMULGATING AGENCY.

The following amendments to Boll Weevil Quarantine regulations make minor administrative changes, delete one report, authorize the Director to establish a scale for penalty collection and formalize a procedure to partially refund fees for cotton acreage destroyed.

Unless specifically mentioned hereunder, the existing regulation remains unchanged.

27-1095. The delegation of authority is changed to the Director, Regulatory and Public Service Programs, vice Department of Plant Industry (which is a subordinate element).

27-1096. The filing date for the Cotton Acreage Reporting Form is changed to July 1 vice April 15, and procedures to obtain approval to plant ornamental cotton are specified.

27-1097 A.

(1) This amendment eliminates requirement for special filing in specified counties, and changes the reporting date to July 1.

(2) This amendment includes a fee for ornamental cotton acreage.

(3) This amendment adds the words "and penalties".

(4) This amendment authorizes the Director to utilize his discretion in assessing the penalty amount, and provides that accounts settled with dishonored checks are subject to penalties assessed for untimely payment as well as penalties associated with dishonored checks.

B. This amendment authorizes the pursuant of deficiencies/failure to pay under any relevant provisions of the law.

C. No Change

D. This amendment authorizes partial refunds or payments, provided the acreage has been subject to hardship conditions and has been destroyed.
