A BILL

TO AMEND ACT 340 OF 1967, AS AMENDED, RELATING TO THE CHARLESTON COUNTY SCHOOL DISTRICT, SO AS TO PROVIDE THAT WHEN A VACANCY OCCURS ON THE CONSTITUENT SCHOOL DISTRICT BOARD OR ON THE CHARLESTON COUNTY SCHOOL DISTRICT BOARD, THE COUNTY COUNCIL SHALL APPOINT A TRUSTEE TO SERVE UNTIL THE NEXT GENERAL ELECTION OR UNTIL THE GENERAL ELECTION FOLLOWING THE NEXT GENERAL ELECTION IF THE VACANCY OCCURS FEWER THAN FOUR MONTHS BEFORE THE GENERAL ELECTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 1A of Act 340 of 1967, as last amended by Act 763 of 1988, is further amended to read:

"Section 1A. Candidates for the constituent school district board of trustees shall file with the county election commission prior to before September first of each election year. Candidates so filed who meet this filing requirement must be placed upon the ballot in the general election without any a party designation and in alphabetical order. If a vacancy occurs four months or more before the next general election, the Charleston County Council shall appoint a trustee to serve until a successor is elected in that general election and qualifies. If a vacancy occurs fewer than four months before the next general election, and more than two years remain in the unexpired term, the Charleston County Council shall appoint a trustee to serve until a successor is elected in the general election following that general election and qualifies."

SECTION 2. Paragraph 2 of Section 2 of Act 340 of 1967 is amended to read:

"Upon the expiration of the term of each member, his each successor shall must be a qualified elector of the same area and shall must be elected in the general election preceding such the expiration date by the qualified electors of the entire county for a term of four years and until his a successor is elected and qualifies. In the event of a vacancy on the board, due to cause other than expiration of term, the vacancy shall be filled for the remainder of the unexpired term by appointment by the Governor upon the recommendation of a majority of the Charleston County Legislative Delegation. If a vacancy occurs four months or more before the next general election, the Charleston County Council shall appoint a trustee to serve until a successor is elected in that general election and qualifies. If a vacancy occurs fewer than four months before the next general election and more than two years remain in the unexpired term, the Charleston County Council shall appoint a trustee to serve until a successor is elected in the general election following that general election and qualifies."

SECTION 3. This act takes effect upon approval by the Governor.
