A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-20-387 SO AS TO PROVIDE REQUIREMENTS BEFORE A COUNTY DISABILITIES AND SPECIAL NEEDS BOARD PURCHASES REAL PROPERTY LOCATED WITHIN OR ADJACENT TO A RESIDENTIAL AREA.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 44-20-387. Before a county disabilities and special needs board purchases real property located within or adjacent to a residential area on which clients of the Department of Disabilities and Special Needs will reside, the board shall conduct a public hearing in the area on its intended use of the property. Notice of the public hearing must be published in a newspaper of general circulation within the area at least two weeks before the hearing. Notice also must be given by displaying a sign on the property for at least two weeks before the hearing."

SECTION 2. This act takes effect upon approval by the Governor.
