TO APPROVE REGULATIONS OF THE BOARD OF EDUCATION, RELATING TO CRITERIA FOR PROMOTION OF STUDENTS TO THE NEXT HIGHER GRADE (AMENDED), DESIGNATED AS REGULATION DOCUMENT NUMBER 1741, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Board of Education, relating to Criteria for Promotion of Students to the Next Higher Grade (Amended), designated as Regulation Document Number 1741, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.

Regulation 43-269, Criteria for the Promotion of Students to the Next Higher Grade, provides for remedial instruction. Since Act 135 of 1993 repeals the remedial and compensatory programs provided for in Section 59-5-65(9) and Section 59-20-40(7) of the South Carolina Code of Laws, as amended, the wording of the above-referenced regulation required amendment. Further, Proviso 20.83 of the 1993 Appropriations Act specifies that for the 1993-94 school year, the basic skills assessment tests will not be administered in Grades 1 and 2 and only the basic skills science and writing tests will be administered in Grade 6. The above-referenced regulation has been revised to provide for situations when state tests are not administered at the grades specified by the regulation. Other revisions in the wording of the regulation have been made for clarification purposes.
