TO AMEND SECTION 61-9-50, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PRESENTATION OF FALSE INFORMATION TO PURCHASE BEER OR WINE, SO AS TO PROHIBIT AN ATTEMPT TO PURCHASE WITH FALSE VERBAL OR WRITTEN INFORMATION AND AUTHORIZE THE SELLER TO RETAIN THE AGE IDENTIFICATION USED IN A VIOLATION; AND TO AMEND SECTION 61-9-70, RELATING TO PENALTIES PERTAINING TO THE PURCHASE, SO AS TO INCREASE THE FINE AND TERM OF IMPRISONMENT AND PROVIDE FOR SUSPENSION OF A DRIVER'S LICENSE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 61-9-50 of the 1976 Code is amended to read:
"Section 61-9-50. It shall be is unlawful for any a person to whom beer or wine cannot be sold lawfully sold to knowingly give to present false verbal or written information concerning his age for the purpose of purchasing to attempt to purchase beer or wine. A seller of beer or wine may retain for delivery to law enforcement the driver's license or other age identification used in violation of this section."
SECTION 2. Section 61-9-70 of the 1976 Code is amended to read:
"Section 61-9-70. Any A person violating the provisions of Sections 61-9-50 and 61-9-60 shall, upon conviction, must be fined not less than fifty one hundred nor more than one two hundred dollars or be imprisoned for not more less than thirty nor more than sixty days, or both, in the discretion of the court. A person violating the sections, upon conviction, also must have his driver's license suspended for one year."
SECTION 3. This act takes effect upon approval by the Governor.
