A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 10 TO TITLE 44, CHAPTER 43, SO AS TO ESTABLISH THE ORGAN AND TISSUE DONOR PROGRAM WITHIN THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL; AND TO ADD SECTION 56-1-143 SO AS TO PROVIDE THAT THE DEPARTMENT OF REVENUE AND TAXATION SHALL OFFER PERSONS OBTAINING OR RENEWING A DRIVER'S LICENSE THE OPPORTUNITY TO CONTRIBUTE ONE DOLLAR TO THE ORGAN AND TISSUE PROGRAM AND THESE FUNDS MUST BE CREDITED TO AN ACCOUNT IN THE STATE TREASURER'S OFFICE FOR USE BY THE DEPARTMENT FOR THIS PROGRAM.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Article 10

The Organ and Tissue Donor Program

Section 44-43-810. There is established in the Department of Health and Environmental Control the Organ and Tissue Donor Program to promote organ and tissue donations. The department shall promulgate regulations containing guidelines and procedures for use of the funds credited to the department from contributions to the fund pursuant to Section 56-1-143."

SECTION 2. The 1976 Code is amended by adding:

"Section 56-1-143. The Department of Revenue and Taxation shall offer in writing an applicant for a new or renewal driver's license, commercial driver's license, or motorcycle driver's license an opportunity to make a contribution of one dollar to be credited to the Department of Health and Environmental Control Organ and Tissue Donor Program. The one dollar contribution must be added to the license fee and credited to a separate account established in the State Treasurer's office for use by the Department of Health and Environmental Control for the organ and tissue donor."

SECTION 3. This act takes effect on the first day of the fourth month following approval by the Governor.
