AN ACT TO AMEND SECTION 16-15-140, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO COMMITTING OR ATTEMPTING TO COMMIT A LEWD ACT UPON CERTAIN CHILDREN, SO AS TO REVISE THE AGE OF A VICTIM OF THIS OFFENSE.
Be it enacted by the General Assembly of the State of South Carolina:
Lewd act upon a minor
SECTION 1. Section 16-15-140 of the 1976 Code, as added by Act 184 of 1993, is amended to read:
"Section 16-15-140. It is unlawful for a person over the age of fourteen years to wilfully and lewdly commit or attempt a lewd or lascivious act upon or with the body, or its parts, of a child under the age of sixteen years, with the intent of arousing, appealing to, or gratifying the lust or passions or sexual desires of the person or of the child.
A person violating the provisions of this section is guilty of a felony and, upon conviction, must be fined in the discretion of the court or imprisoned not more than fifteen years, or both."
Time effective
SECTION 2. This act takes effect upon approval by the Governor.
