AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-17-423 SO AS TO REQUIRE THE USE OF APPROVED BYCATCH REDUCTION DEVICES IN SHRIMP TRAWLS.
Be it enacted by the General Assembly of the State of South Carolina:
Shrimp trawls, bycatch reduction devices
SECTION 1. The 1976 Code is amended by adding:
"Section 50-17-423. (A) Any shrimp trawl made in part or total of webbing less than two and one-half inches stretched mesh and exceeding a foot rope length of sixteen feet used in the waters of this State must contain one or more department-approved, properly installed bycatch reduction devices when trawling.
(B) When a vessel is underway, this section applies to nets attached to trawl doors.
(C) When a vessel is moored at a dock or anchored, this section applies to nets attached to trawl doors or hung in the vessel's rigging.
(D) The department may exempt nets utilized by persons holding a valid scientific collection permit issued by the department."

SECTION 2. This act takes effect upon approval by the Governor.
