TO APPROVE REGULATIONS OF THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL, RELATING TO SOLID WASTE MANAGEMENT, LAND APPLICATION OF SOLID WASTE, DESIGNATED AS REGULATION DOCUMENT NUMBER 1895, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Department of Health and Environmental Control, relating to solid waste management, land application of solid waste, designated as Regulation Document Number 1895, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
SUMMARY AS SUBMITTED BY PROMULGATING AGENCY.
This regulation addresses the land application of nonhazardous solid waste on or into land that is managed to produce crops or forest products and to applications of solid waste on land that is being reclaimed to enhance its aesthetic value or to reduce environmental degradation. This regulation will encourage and establish criteria for the recycling of materials that historically have been disposed in a landfill. The land application of nonhazardous solid waste shall be for beneficial agricultural, silvicultural, and horticultural purposes and not used as a means of disposal.
