TO APPROVE REGULATIONS OF THE DEPARTMENT OF INSURANCE, RELATING TO UNIFORM CLASSIFICATION AND TERRITORIAL PLAN, AUTOMOBILE, DESIGNATED AS REGULATION DOCUMENT NUMBER 1929, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Department of Insurance, relating to uniform classification and territorial plan, automobile, designated as Regulation Document Number 1929, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
Section 38-73-720 of the 1976 Code authorizes the Director of Insurance to fix, establish, and promulgate class and territorial plans via order. See Code of Laws of South Carolina, 1976, Section 38-73-720. The Director of Insurance repeals this regulation (69-13.4) establishing risk classifications and territories for automobile insurance and will promulgate these revised plans by order as provided by this section. Because these plans should be established by order, rather than promulgated in an agency regulation, the Director of Insurance has repealed Regulation 69-13.4.
