A BILL

TO AMEND SECTION 40-22-220, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE QUALIFICATIONS FOR REGISTRATION AS A PROFESSIONAL LAND SURVEYOR, SO AS TO DELETE CERTAIN LANGUAGE AND PROVISIONS, AND PROVIDE, AMONG OTHER THINGS, FOR GRADUATION FROM A SCHOOL OR COLLEGE OF TWO OR MORE YEARS WITH AN ASSOCIATE DEGREE IN AN ABET COMMISSION ACCREDITED CURRICULUM OF ENGINEERING TECHNOLOGY OR LAND SURVEYING, INCLUDING COMPLETED COURSES IN SURVEYING AND MAPPING OF NOT LESS THAN TWELVE SEMESTER HOURS OR THE EQUIVALENT IN QUARTER HOURS SATISFACTORY TO THE BOARD; TO AMEND SECTION 40-22-240, RELATING TO THE QUALIFICATIONS FOR REGISTRATION AS A TIER B PROFESSIONAL LAND SURVEYOR, SO AS TO PROVIDE FOR FIFTEEN, RATHER THAN TWELVE, SEMESTER HOURS OR THE EQUIVALENT IN QUARTER HOURS OF SURVEYING, MAPPING, HYDRAULICS, AND HYDROLOGY COURSES; TO AMEND SECTION 40-22-250, RELATING TO THE QUALIFICATIONS FOR CERTIFICATION AS LAND SURVEYOR-IN-TRAINING, SO AS TO DELETE CERTAIN LANGUAGE AND PROVISIONS, AND PROVIDE, AMONG OTHER THINGS, FOR THE COMPLETION OF COURSES IN SURVEYING AND MAPPING OF NOT LESS THAN TWELVE SEMESTER HOURS OR THE EQUIVALENT IN QUARTER HOURS; AND TO AMEND SECTION 40-22-280, RELATING TO ENGINEERS AND LAND SURVEYORS, APPLICATIONS FOR REGISTRATION, AND REFERENCES, SO AS TO CHANGE THE PROVISIONS CONCERNING REFERENCES FOR ENGINEERING REGISTRATION AND LAND SURVEYING REGISTRATION.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 40-22-220(2) of the 1976 Code, as added by Act 99 of 1991, is amended to read:

"(2) graduation from a school or college of two or more years with an associate degree in an ABET Commission accredited curriculum of engineering technology or land surveying, including completed courses in surveying courses of a character and mapping of not less than twelve semester hours or the equivalent in quarter hours satisfactory to the board, and a specific record of four or more years of progressive practical experience of a character satisfactory to the board and performed under a practicing registered professional land surveyor or other comparable and equivalent supervision, and passing of the Land Surveyor-in-Training Fundamentals of Land Surveying examinations and the written or written and oral examinations in the Principles and Practices of TIER A Land Surveying as prescribed by the board."

SECTION 2. Section 40-22-240 of the 1976 Code, as added by Act 99 of 1991, is amended to read:

"Section 40-22-240. The minimum evidence satisfactory to the board that an applicant is qualified for registration as a TIER B Professional Land Surveyor is: graduation from a school or college of four or more years with a bachelor of science degree, including in the curriculum not less than fifteen semester hours or the equivalent in quarter hours of surveying, mapping, hydraulics, and hydrology courses satisfactory to the board, or a bachelor of engineering technology degree in an ABET Commission accredited curriculum of land surveying or engineering technology including in the curriculum not less than twelve fifteen semester hours or the equivalent in quarter hours of surveying, mapping, hydraulics, and hydrology courses satisfactory to the board, and

(1) a specific record of two or more years of progressive practical experience of a character satisfactory to the board and performed under a practicing registered land surveyor, and

(2) passing of the Land Surveyor-in-Training Fundamentals of Land Surveying Examinations and the written or written and oral examinations in the Principles and Practices of TIER A and TIER B Land Surveying as prescribed by the board."

SECTION 3. Section 40-22-250 of the 1976 Code, as added by Act 99 of 1991, is amended to read:

"Section 40-22-250. The minimum evidence satisfactory to the board that an applicant is qualified for certification as a land surveyor-in-training is:

(1) graduation from a school or college of four or more years with a bachelor of science degree or a bachelor of engineering technology degree in an ABET Commission accredited curriculum of land surveying or engineering technology including in the curriculum not less than twelve semester hours or the equivalent in quarter hours of surveying, mapping, hydraulics, and hydrology completed courses in surveying and mapping of not less than twelve semester hours or the equivalent in quarter hours satisfactory to the board, and a specific record of one or more years of progressive practical experience of a character satisfactory to the board and performed under a practicing registered professional land surveyor, and has passed the written or written and oral examinations in the fundamentals of land surveying as prescribed by the board; or

(2) graduation from a school or college of two years or more with an associate degree in an ABET Commission accredited curriculum of engineering technology or land surveying, including completed courses in surveying courses and mapping of not less than twelve semester hours or the equivalent in quarter hours of a character satisfactory to the board, and a specific record of three years or more of progressive practical experience of a character satisfactory to the board, and performed under a practicing professional land surveyor or other comparable and equivalent supervision, and has passed the written or written and oral examinations in the fundamentals of land surveying as prescribed by the board."

SECTION 4. Section 40-22-280 of the 1976 Code, as added by Act 99 of 1991, is amended to read:

"Section 40-22-280. Applications for registration must be on forms prescribed and furnished by the board and must contain statements made under oath showing the applicant's education and a detailed summary of his technical work.

(1) The application for engineering registration must contain no fewer than five references of whom three or more are who must be registered engineers having personal knowledge of the applicant's engineering experience. In addition, the application must contain references to verify each employment period. The board shall solicit comments from references furnished; these comments must be confidential and privileged information for use only by the board.

(2) The application for land surveying registration must contain no fewer than five references of whom three or more who must be registered land surveyors having personal knowledge of the applicant's land surveying experience. In addition, the application must contain references to verify each employment period. The board shall solicit comments from references furnished; these comments must be confidential and privileged information for use only by the board."

SECTION 5. This act takes effect upon approval by the Governor.
