TO AMEND SECTION 59-20-40, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DETERMINATION OF ANNUAL ALLOCATIONS TO SCHOOL DISTRICTS, SO AS TO IMPOSE A FIVE PERCENT WITHHOLDING PENALTY AGAINST THE ANNUAL ALLOCATION TO ANY SCHOOL DISTRICTS WHICH FAIL TO OFFER INSTRUCTION IN SOUTH CAROLINA AND AFRICAN AMERICAN HISTORY AS MANDATED BY THE PROVISIONS OF SECTION 59-29-55.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 59-20-40 of the 1976 Code is amended by adding at the end:
"(9) Notwithstanding the provisions of this section, five percent of the annual funding allocation shall be withheld from any school district that is determined by the Department of Education to be in noncompliance with the provisions of Section 59-29-55. The amount of any funds withheld pursuant to this item must be maintained in the EIA Fund Special Account and credited to the district from which they are being withheld until such time as the district complies with Section 59-29-55. Upon compliance with Section 59-29-55, as determined by the Department of Education, a district which has been subjected to the penalty prescribed by this item must receive disbursement of the suspended allocations including all interest accruing from the date the funds were withheld."
SECTION 2. This act takes effect upon approval by the Governor.
