A BILL

TO AMEND ARTICLE 3, CHAPTER 31 OF TITLE 5, CODE OF LAWS OF SOUTH CAROLINA 1976, RELATING TO PUBLIC WORKS, BY ADDING SECTION 5-31-290, SO AS TO AUTHORIZE THE DEVOLVING OF CERTAIN POWERS, DUTIES, AND RESPONSIBILITIES GRANTED TO COMMISSIONERS OF PUBLIC WORKS TO A LOCAL GOVERNING BODY BY THE PASSAGE OF AN ORDINANCE OR RESOLUTION AGREEING TO ACCEPT SUCH POWERS, DUTIES AND RESPONSIBILITIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 3, Chapter 31 of Title 5 of the 1976 Code is amended by adding:

"Section 5-31-290. All powers, duties, and responsibilities granted by statute or resolution to a Public Works Commission which affects only one municipality are devolved upon a local governing body if, and to the extent that, the governing body accepts such powers, duties, and responsibilities by ordinance or resolution and notifies the Code Commissioner of its acceptance. The Code Commissioner shall keep a list of such notifications and shall include the information in the statutory notes in each cumulative supplement and revised volume of the Code of Laws of South Carolina.

For purposes of this section, governing body shall mean the county, municipality, city, or town where the public works is located."

SECTION 2. This act takes effect upon approval by the Governor.
