A JOINT RESOLUTION

TO APPROVE REGULATIONS OF THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL, RELATING TO CONTROLLED SUBSTANCES, DESIGNATED AS REGULATION DOCUMENT NUMBER 2162, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The regulations of the Department of Health and Environmental Control, relating to controlled substances, designated as Regulation Document Number 2162, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.

SECTION 2. This joint resolution takes effect upon approval by the Governor.

SUMMARY AS SUBMITTED BY PROMULGATING AGENCY.

The Poisons, Drugs and Other Controlled Substances Act, Section 44-53-10 et seq., provides for the department to protect public health by the control of the manufacturing, distribution, dispensing, and record keeping concerning controlled substances. The act provides that the department, through staff of the Bureau of Drug Control, promulgate regulations to carry out these aforementioned purposes, pursuant to Section 44-53-280(a).

To satisfy these purposes, the department is proposing to amend Regulation 61-4, to revise those sections dealing with references to the name of the bureau; changes to inventory frequency and scope; changes to record keeping requirements; changes to procedures for applying for registration; changing of scheduling of controlled substances, and changes to procedures for controlled substance waste or destruction.

All applicable sections are amended to refer to the "Bureau of Drug Control" instead of "Narcotic and Drug Control Division."
