A BILL

TO AMEND SECTION 41-35-110, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CONDITIONS FOR ELIGIBILITY FOR UNEMPLOYMENT BENEFITS, SO AS TO PROVIDE THAT A PARENT OR GUARDIAN OF A SCHOOL AGED CHILD MAY NOT BE DENIED BENEFITS FOR SEEKING OR ACCEPTING EMPLOYMENT ONLY DURING SCHOOL HOURS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 41-35-110(3) of the 1976 Code is amended by adding:

"(c) Notwithstanding any other provision of Chapters 27 through 41, no otherwise eligible individual who is the custodial parent or guardian of a school aged child may be denied benefits for not being available for work if that individual seeks or accepts work only during the hours when his or her children are in school."

SECTION 2. This act takes effect upon approval by the Governor.
