A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-112-75 SO AS TO ALLOW IN-STATE TUITION RATES FOR PERSONS RESIDING IN NORTH CAROLINA AND GEORGIA COUNTIES CONTIGUOUS TO THIS STATE WHO ENROLL IN TECHNICAL AND PUBLIC TWO-YEAR COLLEGES LOCATED IN COUNTIES IN THIS STATE CONTIGUOUS TO THE BOUNDARIES OF THE NEIGHBORING STATES IF PUBLIC COLLEGES IN THOSE GEORGIA AND NORTH CAROLINA COUNTIES HAVE RECIPROCAL TUITION AGREEMENTS WITH THE AFFECTED SOUTH CAROLINA INSTITUTIONS; AND TO AMEND SECTION 59-112-20, RELATING TO THE DEFINITION OF SOUTH CAROLINA DOMICILE FOR PURPOSES OF IN-STATE TUITION, SO AS TO ALLOW CONSIDERATION OF IN-STATE TUITION FOR INDEPENDENT NONRESIDENTS EMPLOYED FULL-TIME IN THIS STATE AND FOREIGN NATIONALS AND THEIR DEPENDENTS WHEN THE FOREIGN NATIONAL IS EMPLOYED BY A COMPANY WHICH HAS ASSIGNED THE FOREIGN NATIONAL TO FULL-TIME EMPLOYMENT IN OPERATION MANAGED BY THE COMPANY IN THIS STATE WHILE THE FOREIGN NATIONAL REMAINS IN FULL-TIME EMPLOYMENT PURSUANT TO THE ORIGINAL ASSIGNMENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 112, Title 59 of the 1976 Code is amended by adding:

"Section 59-112-75. Persons domiciled in Georgia and North Carolina who reside in counties contiguous to this State are eligible for in-state tuition when enrolling in a technical or two-year college located in a county with a common boundary with one of these states if public colleges in the county in which the person resides have reciprocal in-state tuition agreements with the South Carolina technical or two-year college at which the person seeks to enroll."

SECTION 2. Section 59-112-20 of the 1976 Code is amended by adding at the end:

"E. An independent nonresident person who has full-time employment in this State may be considered eligible for in-state rates while such person remains employed on a full-time basis in this State.

F. Independent nonresident persons who are foreign nationals employed by companies which have assigned them to full-time employment in operations managed by the company in the State, and their dependents, may be considered eligible for in-state tuition rates while such persons are employed with the company on a full-time basis in the State."

SECTION 3. This act takes effect upon approval by the Governor.
