A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 43-1-75 SO AS TO PROVIDE THAT THE DIRECTOR OF THE STATE DEPARTMENT OF SOCIAL SERVICES HAS THE SOLE AUTHORITY TO HIRE AND FIRE ATTORNEYS WORKING FOR THE DEPARTMENT, INCLUDING AT THE COUNTY DEPARTMENTS OF SOCIAL SERVICES AND TO FURTHER PROVIDE THAT ALL DEPARTMENT ATTORNEYS ARE UNDER THE DIRECT CONTROL AND SUPERVISION OF THE GENERAL COUNSEL FOR THE DEPARTMENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 43-1-75. The Director of the State Department of Social Services has the sole authority to hire and fire all attorneys working for the department in any department office, including, but not limited to the state office, a regional office, or any county Department of Social Services. All attorneys employed by the department are under the direct control and supervision of the general counsel for the department."

SECTION 2. This act takes effect upon approval by the Governor.
