A BILL

TO AMEND SECTION 16-11-700, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE OFFENSE OF LITTERING, SO AS TO REQUIRE REPORTING OF CONVICTIONS OF VIOLATIONS OCCURRING WHILE OPERATING A MOTOR VEHICLE TO THE DEPARTMENT OF PUBLIC SAFETY AND REPORTING VIOLATIONS WHILE HUNTING OR FISHING TO THE DEPARTMENT OF NATURAL RESOURCES; AND TO AMEND SECTIONS 50-9-1120 AND 56-1-720, RELATING RESPECTIVELY TO THE POINT SYSTEM FOR DRIVER LICENSES AND HUNTING AND FISHING LICENSES, SO AS TO ASSIGN POINTS UNDER THESE POINT SYSTEMS FOR LITTERING VIOLATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 16-11-700(C)(5) of the 1976 Code, as last amended by Act 63 of 1991, is further amended to read:

"(5) (a) In addition to any other punishment authorized by this section, in the discretion of the court in which conviction is obtained, the person may be directed by the judge to pick up and remove from any public place or any private property, with prior permission of the legal owner upon which it is established by competent evidence that the person has deposited litter, all litter deposited on the place or property by anyone before the date of execution of sentence.

(b) If the conviction under this section occurred while the offender was operating a motor vehicle, the court in which the conviction was obtained shall report the violation to the Department of Public Safety. If the conviction under this section occurred while the offender was engaged in hunting or fishing, the court in which the conviction was obtained shall report the violation to the Department of Natural Resources."

SECTION 2. Section 50-9-1120(1) of the 1976 Code, as added by Act 372 of 1996, is amended by adding an appropriately lettered subitem at the end to read:

"( ) littering in violation of Section 16-11-700 while hunting or fishing: 18."

SECTION 3. That portion of Section 56-1-720 of the 1976 Code containing the schedule of offenses is amended by adding at the end of the schedule:

"Littering in violation of Section 16-11-700 while operating

a motor vehicle..........................................................................6".

SECTION 4. This act takes effect July 1, 1998, and applies with respect to convictions for littering offenses occurring after June 30, 1998.
