AN ACT TO AMEND SECTION 4-23-880, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PARKING WITHIN FIVE HUNDRED FEET OF A PLACE WHERE FIRE APPARATUS IS STOPPED, SO AS TO ALSO RESTRICT PARKING WITHIN FIVE HUNDRED FEET OF AN EMERGENCY VEHICLE AND APPLY THESE RESTRICTIONS WHEN A VEHICLE IS RESPONDING TO AN EMERGENCY RATHER THAN ONLY TO A FIRE ALARM; TO AMEND SECTION 56-5-1960, RELATING TO PROHIBITING FOLLOWING A FIRE APPARATUS CLOSER THAN FIVE HUNDRED FEET, SO AS TO APPLY THIS PROHIBITION WHEN THE FIRE APPARATUS IS RESPONDING TO AN EMERGENCY RATHER THAN ONLY TO A FIRE ALARM; TO ADD SECTION 56-3-3725 SO AS TO REQUIRE THE WRITTEN AUTHORIZATION OF A COLLEGE OR UNIVERSITY FOR ISSUANCE OF A LICENSE PLATE CONTAINING A REFERENCE TO OR USING A SYMBOL OR LOGO OF THE INSTITUTION; AND TO REPEAL SECTION 5-25-30 RESTRICTING THE NUMBER OF HOURS A FIREMAN MAY WORK IN CITIES OF TEN THOUSAND OR MORE.

Be it enacted by the General Assembly of the State of South Carolina:

Prohibiting parking within five hundred feet of a fire apparatus or emergency vehicle

SECTION 1. Section 4-23-880 of the 1976 Code is amended to read:

Section 4-23-880. It is unlawful in the fire district to park within five hundred feet of a place where fire apparatus or an emergency vehicle is stopped in answer to an emergency and no person shall cause any highway, road, either public or private, in the area of fire apparatus or emergency vehicles to be blocked by his vehicle in such a manner that fire apparatus or emergency vehicles will be hindered from reaching the scene of the emergency. It is also unlawful to drive a vehicle over any unprotected hose of a fire department without the consent of the fire department official in command on any street, road, or private driveway when the hose is being used for fire fighting. A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not less than ten dollars or more than one hundred dollars.

Prohibiting following a fire apparatus closer than five hundred feet

SECTION 2. Section 56-5-1960 of the 1976 Code is amended to read:

"Section 56-5-1960. The driver of any vehicle other than one on official business shall not follow any fire apparatus traveling in response to an emergency closer than five hundred feet or stop such vehicle within five hundred feet of any fire apparatus stopped in answer to an emergency."

Institutions authorization required to use reference to or symbol of institution on license plate

SECTION 3. Article 37, Chapter 3, Title 56 of the 1976 Code is amended by adding:

"Section 56-3-3725. License plates issued pursuant to this article shall not contain a reference to a private or public college or university in this State or use symbols, designs, or logos of these institutions without the institution's written authorization."

Repeal

SECTION 4. Section 5-25-30 of the 1976 Code is repealed.

Time effective

SECTION 5. This act takes effect upon approval by the Governor.
