A BILL

TO AMEND SECTION 1-5-10, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE COMPENSATION OF THE SECRETARY OF STATE, SO AS TO PROVIDE THAT A PERSON ELECTED SECRETARY OF STATE IN THE 1998 GENERAL ELECTION OR THEREAFTER SHALL RECEIVE NO COMPENSATION AND EXERCISE NO FUNCTIONS OR DUTIES, AND THAT THE FUNCTIONS AND DUTIES OF THE SECRETARY OF STATE MUST BE DEVOLVED UPON THE GOVERNOR OR HIS DESIGNEE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 1-5-10 of the 1976 Code is amended to read:

"Section 1-5-10 (A) The Secretary of State shall receive such annual salary as may be provided by the General Assembly in subsection (B), and the fees or perquisites of the office shall be paid into the Treasury of the State.

(B) Pursuant to the General Assembly's authority under Article VI, Section 7 of the State Constitution to provide for the duties and compensation of the Secretary of State, a person elected to the office of Secretary of State in the 1998 general election or thereafter shall receive no compensation and exercise no functions or duties. The functions, powers, duties, responsibilities, and authority statutorily exercised by the Secretary of State must be devolved upon the state agencies, together with all assets, liabilities, records, property, personnel, unexpended appropriations, and other funds, in the manner that the General Assembly shall provide by law."

SECTION 2. This act takes effect upon approval by the Governor.
