A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 61-2-145 SO AS TO PROVIDE THAT WHEN AN APPLICATION FOR A BEER AND WINE PERMIT, RETAIL LIQUOR LICENSE, OR MINIBOTTLE LICENSE FILED WITH THE DEPARTMENT OF REVENUE IS DENIED, NO APPLICATION FOR A SIMILAR PERMIT OR LICENSE FOR THE SPECIFIC LOCATION THAT WAS THE SUBJECT OF THE DENIED APPLICATION MAY BE FILED WITH THE DEPARTMENT WITHIN ONE YEAR OF THE DATE THE APPLICATION WAS DENIED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 2, Title 61 of the 1976 Code is amended by adding:

"Section 61-2-145. When the application for a beer and wine permit, retail liquor license, or minibottle license filed with the department is denied, no further application for a similar license or permit for the specific location that was the subject of the denied application may be filed with the department within one year of the date the first application was denied."

SECTION 2. This act takes effect on the first day of the second month following approval by the Governor and applies with respect to applications filed on or after that date.
