A JOINT RESOLUTION TO ALLOW THE DEPARTMENT OF PUBLIC SAFETY TO RETAIN AND EXPEND MOTOR CARRIER REGISTRATION FEES FOR FISCAL YEAR 1996-97.

Whereas, the Department of Public Safety is authorized to retain motor carrier registration fees to control and police illegal transportation and to promote safety on the highways; and

Whereas, prior to restructuring, all motor carrier registration fees were retained by the Public Service Commission and expanded by it to control and police illegal transportation and to promote highway safety; and

Whereas, restructuring transferred these employees to the Department of Revenue and resulted in the passage of temporary provisos 72.67, 72.68, and 72.69 in the 1995-96 Appropriations Act; and

Whereas, these provisos were necessary to continue the legislative intent that the motor carrier registration fees be used to fund these enforcement efforts; and

Whereas, with the transfer of these personnel to the Department of Public Safety effective January 1, 1996, the referenced provisos were subsequently deleted in the 1996-97 Appropriations Act as they were believed to be no longer necessary; and

Whereas, the provisos were in fact the legal basis for retention and expenditure of those fees by the Department of Revenue and later the Department of Public Safety for the legislative purpose for which they are collected; and

Whereas, there was no intent to recapture into the general fund those fees that have been used to this point to underwrite the salaries of those original Public Service Commission employees who have been transferred; and

Whereas, with the deletion of these provisos and the deposit of the collected motor carrier registration fees now into the general fund, the Department of Public Safety has no authorized or appropriated funds available to pay these transferred Public Safety Commission employees. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

Motor carrier registration fees

SECTION 1. The Department of Public Safety is authorized to retain and expend the motor carrier registration fees for fiscal year 1996-97.

Time effective

SECTION 2. This joint resolution takes effect upon approval by the Governor.
