TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 40-33-770 SO AS TO AUTHORIZE LICENSED PRACTICAL NURSES TO PROVIDE CERTAIN SERVICES IN RESIDENTIAL SETTINGS AND PUBLIC SCHOOLS WITHOUT THE ON-SITE SUPERVISION OF A NURSE, DOCTOR, OR DENTIST IF CERTAIN PROCEDURES ARE FOLLOWED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 40-33-770. Notwithstanding Section 40-33-10(h) requiring the practice of practical nursing to be performed under the direction of a registered nurse, licensed physician, or licensed dentist, a licensed practical nurse may provide nursing care authorized for licensed practical nurses under this chapter without the on-site supervision of a registered nurse, licensed physician, or licensed dentist in:
(1) home or residential settings under the Medicaid program, if a registered nurse has approved the plan of care;
(2) public schools, if the licensed practical nurse follows the policies, procedures, and guidelines of the employing school entity and if a registered nurse is available on call by telecommunications."
SECTION 2. This act takes effect upon approval by the Governor.
