A BILL

TO AMEND CHAPTER 1, TITLE 41, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LABOR AND EMPLOYMENT, BY ADDING SECTION 41-1-45 SO AS TO PROVIDE THAT AN EMPLOYER, BEFORE OR AFTER HIRING AN EMPLOYEE, MAY REQUIRE THE EMPLOYEE OR PROSPECTIVE EMPLOYEE TO FURNISH THE EMPLOYER WITH A COPY OF HIS CRIMINAL HISTORY RECORD INFORMATION MAINTAINED BY SLED OR BY THE FBI, TO THE EXTENT ALLOWED BY FEDERAL LAW, OR BOTH.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 1, Title 41 of the 1976 Code is amended by adding:

"Section 41-1-45. (A) On and after the effective date of this section, any employer, before or after hiring an employee, may require the employee or prospective employee to furnish the employer with a copy of his criminal history record information maintained by the State Law Enforcement Division or, to the extent allowed by federal law, his criminal history record information maintained by the Federal Bureau of Investigation, or both.

(B) The cost of the criminal history record information must be paid by the employee or prospective employee unless the employer elects to pay the cost.

SECTION 2. This act takes effect upon approval by the Governor.
