A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 57-5-1625 SO AS TO PROVIDE THAT THE DEPARTMENT OF TRANSPORTATION MAY CONSIDER COSTS IN PROCURING QUALIFIED PROFESSIONAL CONSULTANTS FOR CERTAIN PROJECTS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 57-5-1625. The department may procure qualified professional consultant services in the areas of program management, construction management, feasibility studies, preliminary engineering, design, engineering, surveying, mapping, and architectural related services, for projects within, or to be constructed within, the highway right-of-way. The procurement process shall promote engineering and design quality and shall ensure maximum competition by professional companies of all sizes providing engineering and design services. The department is authorized to consider both qualifications and costs in the selection process for procuring professional consultant services. The procedural requirements for the procurement process must be determined by the department, and may include the establishment of reasonable rates, costs, and compensation for consultants."

SECTION 2. This act takes effect upon approval by the Governor.
