TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 37-11-137 SO AS TO PROVIDE THAT THE STATE CONTINUING CARE RETIREMENT COMMUNITY ACT DOES NOT APPLY TO A COMMUNITY ESTABLISHED AS A HOMEOWNER'S ASSOCIATION OR SUBJECT TO THE HORIZONTAL PROPERTY ACT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 37-11-137. The provisions of this chapter do not apply to a community established as a homeowner's association, as defined in Section 12-43-230, or subject to the Horizontal Property Act, as provided in Chapter 31, Title 27."

SECTION 2. This act takes effect upon approval by the Governor.
