TO REQUEST THE PRESIDENT PRO TEMPORE TO APPOINT A SPECIAL COMMITTEE TO STUDY THE PROBLEM OF JAIL OVERCROWDING IN THIS STATE, AND TO PROVIDE FOR ITS MEMBERSHIP.
Be it resolved by the Senate:
That the President Pro Tempore is hereby requested to appoint a special committee to study the problem of jail overcrowding in this State. The special committee's membership must consist of a representative from the Governor's office, the South Carolina Senate, the South Carolina House of Representatives, the Attorney General's Office, the South Carolina Association of Counties, the South Carolina Jail Administrators' Association, the Department of Corrections, the Department of Probation, Parole, and Pardon Services, and the South Carolina Division of Court Administration. The special committee also must include at least one magistrate, family court judge, circuit court judge, clerk of court, solicitor, public defender, county chief administrative officer who operates a jail, county council member, and a sheriff who operates a jail.
The committee shall examine and review all current state efforts to reduce the number of prisoners housed in the state's jails. The committee shall review the laws of this State and our sister states to determine whether South Carolina statutes should be amended to more effectively reduce the state's jail population. The committee shall offer recommendations as to whether existing laws should be amended or new laws should be adopted to address this issue.
The committee shall provide a report of its findings and may introduce legislation in the name of the members serving on the committee. Upon the issuance of its report and the introduction of legislation, the committee must be discharged.
