A BILL

TO AMEND SECTION 23-6-170, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DEPARTMENT OF PUBLIC SAFETY, HIGHWAY PATROL DIVISION, SO AS TO REQUIRE THE SOUTH CAROLINA PUBLIC SAFETY COORDINATING COUNCIL TO IMPLEMENT A PROMOTION POLICY WHICH SHALL INCLUDE THE RANK OF MASTER TROOPER.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 23-6-170 of the 1976 Code is amended to read:

"Section 23-6-170. No officer or trooper may be promoted to a higher rank until such time as the council adopts a promotion policy for commissioned personnel and officers as provided for in Section 23-6-520.

The council shall adopt a promotion policy which shall include the rank of Master Trooper. The council shall implement the policy as follows:

(1) a trooper who has reached the top of his pay band will be reclassified as a Master Trooper without a pay increase for the reclassification and without the opportunity for future merit increases in pay;

(2) a trooper who has ten years or more of service with the Highway Patrol and has attained a pay level in the middle of the pay band will be reclassified as a Master Trooper without an immediate pay increase for the reclassification but will be eligible for annual merit increases in pay;

(3) a trooper who has ten years or more of service with the Highway Patrol and has not attained a pay level in the middle of the pay band will be reclassified as a Master Trooper, have his pay adjusted to bring him to the middle of the pay band, and will be eligible for annual merit increases in pay;

(4) a trooper who does not have ten years or more of service with the Highway Patrol will be promoted to the rank of Master Trooper after completing ten years of service. Upon his promotion, the trooper will receive a ten percent pay increase and will be eligible for annual merit increases in pay.

In furtherance of the promotion policy, a system based on objective performance criteria shall be adopted to determine merit increases in pay."

SECTION 2. This act takes effect upon approval by the Governor.
