A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 2-1-225 SO AS TO PROVIDE THAT NO PERSON MAY BE APPOINTED BY THE GOVERNOR OR ELECTED BY THE GENERAL ASSEMBLY TO A STATE BOARD OR COMMISSION WHO HAS SERVED CONSECUTIVE FULL TERMS ON THAT BOARD OR COMMISSION WHICH TOTAL TWELVE YEARS OR MORE, AND PROVIDE FOR EXCEPTIONS TO AND THE OPERATION OF THE PROVISIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 2-1-225. No person may be appointed by the Governor or elected by the General Assembly to a state board or commission who has served consecutive full terms on that board or commission which total twelve years or more. The limitation does not prevent a person from being elected or appointed to the same body after an absence of two years. This section does not apply to life members of the Clemson University Board of Trustees and to the members of the board of the State Ports Authority. Persons currently serving on these boards or commissions whose tenure exceeds this twelve-year limitation are permitted to complete their current term."

SECTION 2. This act takes effect July 1, 1999.
