TO AMEND ARTICLE 1, CHAPTER 43 OF TITLE 38, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PROVISIONS OF LAW GOVERNING THE LICENSING AND REGULATION OF INSURANCE AGENTS BY ADDING SECTION 38-43-25, SO AS TO PROVIDE THAT AN AGENT OR EMPLOYEE OF AN AUTOMOBILE RENTAL COMPANY WHO SELLS AUTOMOBILE COLLISION INSURANCE COVERAGE AND ANY OTHER TYPE OF AUTOMOBILE INSURANCE COVERAGE APPLICABLE TO A MOTOR VEHICLE BEING RENTED BY THAT COMPANY SHALL NOT BE DEEMED AN "INSURANCE AGENT".
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 43 of Title 38 of the 1976 Code is amended by adding:
"Section 38-43-25. An agent or employee of an automobile rental company may sell, and collect a premium for, automobile collision insurance coverage and any other type of automobile insurance coverage applicable to a motor vehicle being rented to a consumer by the company, and such agent or employee of the company shall not be deemed an insurance agent within the meaning of this chapter and shall be exempt from all the provisions of this chapter, including specifically, but not limited to, continuing education requirements for insurance agents in Section 38-43-106, as well as any other provisions of law applicable to insurance agents."
SECTION 2. This act takes effect upon approval by the Governor.
