A BILL

TO AMEND SECTION 50-13-1610, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE SALE OR TRAFFIC IN CERTAIN GAME FISH, SO AS TO PROVIDE THAT IT IS UNLAWFUL TO SELL, OFFER FOR SALE, BARTER, TRAFFIC IN, OR PURCHASE SWORDFISH, UNTIL THE NATIONAL MARINE FISHERIES SERVICE DECLARES THIS FISH STOCK FULLY RECOVERED AND TO PROVIDE PENALTIES FOR VIOLATIONS OF THIS SECTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 50-13-1610 of the 1976 Code, as last amended by Act 181 of 1993, is further amended to read:

"Section 50-13-1610. It shall be unlawful, at any time, to sell, offer for sale, barter, traffic in, or purchase swordfish (Xiphias gladius), as a food item or otherwise until the National Marine Fisheries Service declares the Atlantic coast swordfish stock fully recovered, or any game fish so classified under the provisions of Section 50-1-30, except as to fresh-water freshwater trout as provided in Sections 50-13-1680 and 50-13-1740, regardless of where caught. Any person violating this section is guilty of a misdemeanor and, upon conviction, shall for the first offense must be fined not less than one hundred dollars nor more than three hundred dollars. For the second offense within five years of the date of conviction for the first offense, he shall must be fined not less than two hundred dollars nor more than five hundred dollars and be imprisoned for thirty days. For a third offense within five years of the date of conviction for the first offense, he shall must be fined not less than five hundred dollars nor more than one thousand dollars and be imprisoned for not more than thirty days. Fourth and subsequent offenses within five years of the date of conviction for the first offense shall must be punished as provided for a third offense."

SECTION 2. This act takes effect upon approval by the Governor.
