AN ACT TO AMEND ACT 441 OF 1959, AS AMENDED, RELATING TO THE GREENWOOD METROPOLITAN DISTRICT, SO AS TO INCREASE THE MEMBERS ON THE DISTRICT COMMISSION FROM SIX TO SEVEN, TO REQUIRE THREE MEMBERS PREVIOUSLY APPOINTED BY THE GOVERNOR TO BE ELECTED IN THE GENERAL ELECTION BEGINNING IN 2000, TO PROVIDE THAT THE ELECTED MEMBERS SHALL SERVE TWO-YEAR TERMS, AND TO ADD ONE MEMBER TO BE APPOINTED BY THE GREENWOOD COUNTY COUNCIL.
Be it enacted by the General Assembly of the State of South Carolina:
Election of commission members
SECTION 1. Section 2 of Act 441 of 1959, as last amended by Act 680 of 1973, is further amended to read:
"Section 2. The district must be governed by a commission composed of seven members. Beginning in 2000, three members, who must be residents of the district, must be elected by the qualified electors of Greenwood County in a nonpartisan election at the time of the general election. A person desiring to be a candidate shall file a statement of candidacy with the Greenwood County Election Commission as provided by law. The election must be conducted pursuant to Title 7, mutatis mutandis, and the winning candidate must obtain a plurality of the votes cast. Terms of elected members are for two years with terms beginning January first, following the general election.
A vacancy existing on this act's effective date must be filled at the general election in 2000, and other members previously appointed by the Governor shall serve the remainder of their terms and until their successors are elected and qualify in accordance with this section. The three commissioners of public works of the City of Greenwood are ex officio members of the commission and shall serve terms coterminous with their terms of office. One member must be appointed by the Greenwood County Council for a term of four years to begin January 1, 2000. The commission must be known as the Greenwood Metropolitan Commission. Upon their appointment, they shall organize and from among themselves elect a chairman and a secretary and adopt an official seal. They shall procure office quarters within the City of Greenwood where their meetings must be held and their records kept. The chairman shall receive as compensation one hundred twenty-five dollars per month, the secretary shall receive one hundred dollars per month, and the other members of the commission shall receive seventy-five dollars per month, to be paid from the revenue of the district."
Time effective
SECTION 2. This act takes effect upon approval by the Governor.
