AN ACT TO AMEND ACT 1093 OF 1966, AS AMENDED, RELATING TO THE GOOSE CREEK PARK AND PLAYGROUND COMMISSION IN BERKELEY COUNTY, SO AS TO FURTHER PROVIDE FOR MEMBERSHIP ON THE COMMISSION.

Be it enacted by the General Assembly of the State of South Carolina:

Commission

SECTION 1. Section 2 of Act 1093 of 1966, as last amended by Act 603 of 1971, is further amended to read:

"Section 2. The commission shall be composed of seven members, who shall be appointed by the Governor upon the recommendation of a majority of the Legislative Delegation of Berkeley County, who shall serve for terms of four years or until their successors are appointed and qualify, except that of those first appointed two shall serve for terms of four years, two shall serve for terms of three years, two shall serve for terms of two years, and one shall serve for a term of one year or until their successors are appointed and qualify. The seven initial appointees shall draw lots to determine the length of their terms. Any vacancy shall be filled in the manner of the original appointment for the unexpired portion of the term only.

Notwithstanding any other provision of law, so long as an intergovernmental agreement exists between the City of Goose Creek and the Goose Creek Park and Playground Commission for the providing of recreational services to residents of Goose Creek, the General Assembly deems that, for purposes of representation only, the area of the city is deemed to be part of the Goose Creek Park and Playground Commission. No more than three members may be residents of the City of Goose Creek. Upon expiration or termination of the intergovernmental agreement between the City of Goose Creek and the Goose Creek Park and Playground Commission, any member serving on the commission representing the City of Goose Creek is deemed ineligible to serve and his seat is deemed vacant."

Time effective

SECTION 2. This act takes effect upon approval by the Governor.

Ratified the 1st day of March, 2000.
